The website https://www.atelierdupeyron.com est amené à collecter des données dans le cadre du formulaire de contact, ou de la boutique en ligne par les applications Woocommerce et Stripe. Il s’agit des informations fournies volontairement par l’internaute, dans l’objectif d’envoyer un message ou de passer une commande, à savoir : nom, prénom, adresse postale, adresse e-mail, numéro de téléphone, données transactionnelles nécessaires à une commande. Ces données sont utilisée par Magdalena Larderet dans le but de traiter une commande et l’artiste s’engage à ne jamais les communiquer à des tiers.
The bank details entered in the Stripe online payment form are secure. This data is exchanged directly with Stripe and the website https://www.atelierdupeyron.com ne conserve pas ces informations et n’y a pas non plus accès.

Terms and conditions of service

Customer's duties

  • The person making a purchase on the site https://www.atelierdupeyron.com declares that he/she is of legal age in the country in which he/she resides, and that he/she has the legal capacity or parental authorisation to place an order on the Site.
  • When registering his/her personal data to place an order, the latter must ensure the accuracy of the mandatory data he/she provides. In the event of an error in the recipient's details, Magdalena Larderet cannot be held responsible for the possible non-delivery of the product.

Products

  • Certain products presented on the site are only available there and in limited quantities. The only returns accepted are within the limits of the right of withdrawal described below. Magdalena Larderet has made every effort to present the photos and colours of each piece as accurately as possible, but cannot guarantee that the display on your screen will faithfully reflect the original colours.
  • Magdalena Larderet has the right to limit sales to certain countries and to limit the quantities of all the pieces we offer. Magdalena Larderet has the right to change the description of the items on sale at any time.

Coments and feedback

  • If, at our request, you send us certain specific submissions (for example, contest entries) or if, without our having asked you to do so, you send us creative ideas, suggestions, proposals, plans or other materials, whether online, by e-mail, by regular mail or otherwise (collectively, the "Comments"), you agree that we may, at any time and without limitation, edit, copy, publish, distribute, translate and use in any way, in any media, the Comments that you send to us. We are and shall be under no obligation (1) to maintain any comments in confidence, (2) to pay any compensation for any comments, or (3) to respond to any comments.
  • We will monitor, edit or remove content that we deem, in our sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable, or that violates any party's intellectual property or these Terms of Use.
  • You agree that your comments will not infringe any third party rights, including copyright, trademark, privacy, personality or other personal or proprietary rights. You also agree that your comments will not contain any defamatory or otherwise unlawful, abusive or obscene material, or any computer virus or other malicious software that may in any way affect the operation of the service or any related website.
  • You may not use a false e-mail address, pretend to be someone other than yourself, or mislead us or third parties as to the origin of your comments. You are solely responsible for the comments you make and their accuracy. We take no responsibility for comments posted by you or by third parties.

Pricing

  • Prices are quoted in euros, inclusive of all taxes but exclusive of delivery charges. Shipping costs are indicated when the customer places the order and before payment is made. Shipping costs may vary depending on the item ordered.
  • Magdalena Larderet may revise its prices at any time, but the products will be invoiced based on the price at the time the order is registered.

Placing an order

  • Validation of any online order implies acceptance by the user of all of these general terms and conditions of service. The user thereby acknowledges that he/she has fully understood them. The user will show his//her acceptance by ticking the box next to the phrase "I agree with the terms and conditions" during the ordering process. Ticking this box is considered to have the same value as a handwritten signature on the part of the user.
  • Magdalena Larderet may cancel an order. If this is the case, the customer will be fully refunded.


Payment

Shipping and delivery

  • Shipments will only be made once payment has been received.
  • Delivery times may vary depending on the preparation time required to pack the items, which can take up to 5 days, but Magdalena Larderet undertakes to prepare the order as quickly as possible. To this must also be added the time required by the carrier, which will be taken care of by La Poste or Mondial Relay. In France, delivery times are generally 3 to 5 working days. In Europe, 14 days, and in the rest of the world, delivery times may vary depending on the destination country.
  • If Magdalena Larderet, for any reason, is delayed in sending the order, the client will be informed by e-mail or telephone.
  • Magdalena Larderet cannot be held responsible for the consequences of a delay in delivery by the carrier.
  • As long as the merchandise has not been delivered to the buyer, Magdalena Larderet remains the owner of the merchandise, and as such is responsible for taking recourse against the carrier in the event of damage or lost items (Article L. 216-2 of the French Consumer Code). It is the buyer's responsibility to check that the package is in good condition and to express any concerns on the delivery slip, and to notify Magdalena Larderet without delay using the website's contact form.

Right of cancellation

  • The client may exercise his/her right of cancellation within 14 days from the day following delivery of the product. If the client wishes to do so, he/she must inform Magdalena Larderet by e-mail of their wish to return the product. They must then return the product within a maximum of 14 days following their request for cancellation. The product must be returned by the client undamaged, protected in its original packaging, to the address that will be communicated to him/her.
  • If the product is returned damaged or past the legal deadline, no refund will be possible.
  • Shipping costs are charged to the customer. The delivery costs for the first shipment, as well as the fees charged by Stripe (corresponding to the price at the time of the order (1.5% of the total amount plus 0.25 cents (in 2023) on the initial payment will not be refunded.

Dispute resolution

  • In the event of a dispute, the client and Magdalena Larderet agree, before taking any legal action, to work together to find an amicable solution.
